These terms apply to the use of this website and to all quotations, assignments and agreements of Neurofactor, part of Axon Group, based in the Netherlands.

Neurofactor is a neuromarketing agency and part of Axon Group. We conduct neuroscientific and behavioural research and translate it into strategy, marketing, sales, recruitment and experience.

These terms apply to every visit to this website and to every quotation, order confirmation and agreement between Neurofactor and a client, unless agreed otherwise in writing.
Purchasing or other terms of the client apply only when Neurofactor has accepted them explicitly and in writing.
Quotations are without obligation and valid for thirty days unless stated otherwise. An agreement is formed once the client accepts a quotation or proposal in writing or by email, or once Neurofactor starts work with the client's consent.
Changes affecting scope, planning or cost are agreed in advance and confirmed in writing.
Neurofactor performs assignments on a best-efforts basis, according to sound scientific judgement and with due care. Research results are observations and interpretations; they are not a guarantee of commercial outcomes.
We are explicit about the limits of each method. Claims are made only to the extent that the measurement, sample and context support them.
Participation in research is always voluntary and based on informed consent. Participants may stop at any moment, without giving a reason and without consequences.
Neurofactor does not accept assignments aimed at deception, at exploiting vulnerability, or at bypassing conscious choice. We reserve the right to refuse or end an assignment on ethical grounds.
Prices are in euros and exclude VAT and expenses unless stated otherwise. Invoices are paid within thirty days of the invoice date.
If the payment term is exceeded, the client owes statutory commercial interest and reasonable collection costs. Neurofactor may suspend work while a due invoice remains unpaid.
Methods, models, measurement protocols, software, templates and underlying knowledge remain the property of Neurofactor. After full payment, the client receives a non-exclusive right to use the delivered report for its own business purpose.
Publication of results naming Neurofactor happens only in consultation. Neurofactor may use anonymised and aggregated insights for scientific development, teaching and publication, without data traceable to the client or participants.
Both parties treat each other's confidential information with care and do not share it with third parties without consent, except where required by law. This obligation continues after the assignment ends.
Neurofactor's liability is limited to the amount invoiced for the relevant assignment, capped at the amount paid out by our liability insurance in the relevant case.
Neurofactor is not liable for indirect damage, consequential loss, lost profit or damage resulting from decisions the client takes on the basis of the report. This limitation does not apply in case of intent or wilful recklessness.
